Custom Label Terms & Research-Use Policy

These Custom Label Terms govern your purchase of custom-printed labels from VialArt ("we," "us"). By placing an order or checking the certification box at checkout, you agree to these terms.
1. Research Use Only
VialArt is a custom label printing service. We print labels onto adhesive vinyl. We do not manufacture, compound, sell, supply, endorse, or take any position on any substance you choose to label. All labels are sold for Research Use Only and are Not for Human Consumption. Labels are not pharmaceutical products, are not approved by any regulatory authority, and must not be used to label any product intended for human or animal ingestion, injection, or therapeutic use.
2. Your Responsibility & Compliance
You are solely responsible for the legality of the substances you label and for how those substances and labels are used, stored, transferred, or sold. You represent and warrant that your purchase and intended use comply with all applicable federal, state, and local laws and regulations. VialArt has no knowledge of, and accepts no responsibility for, the contents of any vial or container to which our labels are applied.
3. Intellectual Property & Uploaded Artwork
If you upload artwork, text, logos, or other content, you represent and warrant that you own that content or are fully licensed to use and reproduce it. You grant VialArt a limited, non-exclusive license to reproduce your content solely to fulfill your order. You retain ownership of your content.
4. Prohibited Content
You may not order labels that include, and we will refuse or cancel any order that includes:
- Registered pharmaceutical brand names or pharmaceutical company names/logos you are not authorized to use (e.g., reproducing a brand wordmark). Generic compound/chemical names are permitted.
- Counterfeit or imitation packaging — National Drug Code (NDC) numbers, "Rx only" designations, FDA/USP/certification seals or logos, anti-counterfeit/authentication marks, or any styling designed to imitate or be mistaken for an authentic regulated product.
- Medical or treatment claims — e.g., "FDA approved," "treats/cures," human dosing instructions, or any claim of human or therapeutic use.
- Reproduction of a real branded drug's label, including replacing or recreating the label of an existing branded product.
- Any content that is unlawful, infringing, or fraudulent.
We screen orders for the above and may hold, refuse, or cancel any order at our sole discretion. Refusing or canceling such an order is not a breach of these terms.
5. Indemnification
You agree to indemnify, defend, and hold harmless VialArt and its owners, employees, and agents from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your content or artwork; (b) your use, sale, transfer, or labeling of any substance; (c) your breach of these terms or of any law; or (d) any third-party claim of infringement relating to content you supplied.
6. Custom Items Are Final
Custom-printed labels are made to order to your specifications and cannot be changed, canceled, or returned once confirmed. You are responsible for reviewing and approving your label before confirming. Our promise: if we misprint or there is a defect on our end, we will remake your order free of charge.
7. Limitation of Liability
To the maximum extent permitted by law, VialArt's total liability for any claim arising from your order is limited to the amount you paid for that order. VialArt is not liable for any indirect, incidental, consequential, or punitive damages.
8. Changes
We may update these terms from time to time. The version in effect at the time of your order applies to that order.
