Terms of Service
Last updated June 14, 2026. By accessing, using, or placing an order through VialArt ("Company," "we," "us," or "our"), you agree to these Terms of Service and to our Privacy Policy. If you do not agree, please do not use the site.
1. Printing service only
VialArt provides custom label design, customization, and printing services. We do not manufacture, sell, distribute, test, verify, approve, certify, or endorse any substance, compound, medication, supplement, chemical, research material, or product that may be referenced on labels created through our platform. You are solely responsible for all content you submit for printing and for how printed labels are used.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use the site or place an order. By ordering, you represent that you meet these requirements.
3. Electronic agreement
By using the site, creating an account, checking an acceptance box, or placing an order, you agree that such actions constitute your electronic signature and acceptance of these Terms.
4. Your content & responsibilities
You represent and warrant that:
- you own or have obtained all rights, licenses, permissions, and authorizations for any text, artwork, logos, trademarks, images, designs, product names, QR codes, barcodes, and other content you submit ("Your Content");
- Your Content does not infringe any intellectual-property, privacy, publicity, or other right of any third party;
- Your Content, and your intended use of it, comply with all applicable laws, regulations, and industry requirements;
- Your Content does not reference controlled substances, prescription drugs, or any item whose labeling, sale, or distribution requires a license, registration, or regulatory approval you do not hold; and
- you are solely responsible for the accuracy of all information appearing on any printed label.
5. No regulatory review
We do not review, verify, validate, approve, or guarantee any product name, ingredient information, dosage, direction, storage instruction, safety warning, regulatory statement, batch or lot number, QR-code destination, or scientific, medical, or health claim. Any screening, filtering, or refusal we perform is discretionary, is offered as a courtesy, does not create a duty to review, and does not transfer responsibility for Your Content to us. You are solely responsible for ensuring all label content complies with applicable laws and regulations.
6. Customer approval
By submitting an order, you acknowledge that you have reviewed and approved all text, spelling, grammar, dosage information, QR codes, colors, layout, sizing, and design elements. VialArt is not responsible for customer-approved errors.
7. Custom, made-to-order products & refunds
Our products are personalized and printed to order from the content and options you provide. Because they are made to your specifications, all sales are final and custom items are non-refundable, except as required by law or as stated in our Returns & Order Policy. If your order arrives with a manufacturing or print defect, we will remake or replace the affected labels at no charge — see the Returns & Order Policy for how to report a defect. We produce exactly what you confirm.
8. Orders, pricing & payment
All orders are subject to acceptance and availability. Prices are shown in U.S. dollars and applicable taxes are calculated at checkout. Payments are processed securely by our third-party payment providers; we do not store full card numbers. Prices and product details may change at any time, and we may correct errors and cancel affected orders even after an order is placed.
9. Chargebacks & payment disputes
Customers agree to contact VialArt before initiating any chargeback or payment dispute. Where tracking, delivery confirmation, production records, design approvals, order approvals, or proof approvals demonstrate fulfillment of the order, such records may be used to contest disputes. Fraudulent chargebacks may result in account suspension and collection efforts where permitted by law.
10. Shipping & delivery
Estimated production and shipping times are estimates only and are not guaranteed. Risk of loss passes to you when we hand the order to the carrier, and we are not responsible for carrier delays. See our Shipping Policy for details.
11. Intellectual property & IP complaints
You retain ownership of Your Content. By submitting it, you grant VialArt a limited, non-exclusive license to reproduce, modify, process, store, and print it solely to fulfill your order and operate the service. All other site content, branding, and software are owned by VialArt or its licensors. If you believe content on our platform infringes your intellectual-property rights, contact us through our contact form with enough detail to identify the work and the allegedly infringing material, and we will respond appropriately.
12. Design storage
While VialArt may retain design files for customer convenience, we do not guarantee permanent storage, retention, backup, or future availability of any design, artwork, order history, or digital asset. You are responsible for keeping your own copies of anything you wish to preserve.
13. Prohibited content; right to refuse
We may refuse, cancel, or remove any order, and may restrict or terminate access to the platform, at our sole discretion and for any reason, including content that violates applicable law; infringes intellectual-property rights; is fraudulent, deceptive, defamatory, threatening, or harassing; or that references controlled substances, prescription medications, regulated pharmaceuticals, counterfeit products, infringing trademarks, unlawful products, or any content that creates legal, regulatory, reputational, or operational risk. Exercising or declining to exercise this right does not make us responsible for Your Content.
14. Disclaimers
The site and products are provided "as is" and "as available." To the fullest extent permitted by law, VialArt disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and regulatory compliance. Our products are blank-labeling and printing materials; you are responsible for how they are used.
15. Limitation of liability
To the maximum extent permitted by law, VialArt and its owners, officers, employees, contractors, affiliates, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages; lost profits or revenue; business interruption; regulatory penalties; product recalls; or labeling errors supplied by you. In no event will VialArt's total liability for any claim exceed the amount you paid for the order giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
16. Indemnification
You agree to defend, indemnify, and hold harmless VialArt and its owners, officers, employees, contractors, affiliates, and suppliers from any claim, damage, liability, loss, cost, penalty, fine, judgment, or expense (including reasonable attorneys' fees) arising from Your Content; any intellectual-property, trademark, or copyright dispute; any regulatory or product-labeling violation; misuse of printed materials; or your violation of these Terms.
17. Dispute resolution — binding arbitration & class-action waiver
Please read this section carefully — it affects your legal rights. Except for claims that qualify for small-claims court and claims to protect intellectual property, any dispute arising out of or relating to these Terms or our products will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Clark County, Nevada, rather than in court. You and VialArt waive any right to a jury trial and to participate in any class, collective, or representative action. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by sending an opt-out notice through our contact form that states your name and that you opt out; opting out does not affect the rest of these Terms.
18. Governing law
These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-laws principles. To the extent any dispute is not subject to arbitration, it will be handled exclusively in the state or federal courts located in Clark County, Nevada, and you consent to their jurisdiction.
19. Changes to these Terms
We may modify these Terms at any time. The "last updated" date above reflects the latest version, and your continued use of the service after changes take effect constitutes acceptance of the updated Terms.
20. General
If any provision of these Terms is found unenforceable, the remaining provisions stay in full effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with our Privacy Policy and Returns & Order Policy, are the entire agreement between you and VialArt regarding the service and supersede any prior agreements.
